We operate the PreStartGo software and hardware solution ("PreStartGo Solution" or "Service") designed to enhance workplace safety and compliance for machinery pre-starts.

This Privacy Statement explains how we collect, use, disclose, store, secure, and dispose of your personal information in accordance with the Australian Privacy Act 1988 (Cth) (the "Privacy Act") and the Australian Privacy Principles (APPs).

This Statement applies to Users of the PreStartGo Solution, including Operators, Account Users, Site Workers, and other individuals whose personal information we may handle in providing the Service.

2. What Personal Information Do We Collect?

"Personal Information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable. The types of personal information we may collect include:

  • Identity and Contact Information: Your name, mobile phone number, email address.

  • Authentication Information: Passwords (stored securely using hashing/encryption), PINs used for login verification.

  • Employment-Related Information: Your employer or the entity holding the Account you are associated with, your assigned Role within the PreStartGo Solution (e.g., Operator, Supervisor, Site Worker), information regarding your training, competencies, licenses, and certifications required to operate specific machinery (which may be considered Sensitive Information – see Section 3).

  • Operational Information: Records of your use of the Service, including machines you interact with (identified via Tag scan), pre-start checklists you complete, responses provided within checklists, machine faults or issues you report (including any notes or photos submitted via the App), machine start and stop times, machine hour meter readings or mileage you input, and acknowledgements of safety notices or Job Safety requirements.

  • Location Information: If enabled (typically part of the Machine Service Add-on or Site Safety Add-on), precise GPS location data associated with the PreStartGo Interlock Device installed on machinery, potentially linked to your activity log. Approximate location information may also be used for site geofencing features.

  • Site Information: Records of your induction status for specific geographic sites, site check-in and check-out times (if using the Site Safety Add-on).

  • Device Information: Information about the mobile device you use to access the PreStartGo App, such as device type, operating system version, App version, and Bluetooth connectivity status (primarily for troubleshooting and service improvement).

  • Support Information: Information you provide when you contact us for support, including the nature of your query and our communications with you.

3. Collection of Sensitive Information

Certain information, such as details about your licenses, certifications, or specific competencies required for machine operation, may be considered "Sensitive Information" under the Privacy Act. We will only collect sensitive information where it is reasonably necessary for the functions of the PreStartGo Solution (e.g., verifying competency to operate machinery) and typically:
* With your express or implied consent (e.g., by providing it directly in the App or via your employer); or
* Where provided to us by your employer (the Account Holder) who warrants they have obtained necessary consents or have a lawful basis for providing it.

4. How We Collect Your Personal Information

We collect personal information in various ways, including:

  • Directly from You: When you register for the App, log in, complete pre-start checklists, report faults, input machine hours, update your profile, contact support, or otherwise interact directly with the Service.

  • From Your Employer or Account Holder: Your employer or the entity managing the PreStartGo Account may provide us with your name, contact details, assigned Role, competencies, site induction status, and associate you with specific Groups or Sites.

  • Automatically Through the Service:

    • When you use the App, we log operational data like checklist submissions and machine interactions.

    • The PreStartGo Interlock Device automatically transmits location data (if enabled) and operational status (e.g., ignition on/off) via Bluetooth to the App.

    • We collect standard device and usage information via the App.

5. Why We Collect, Hold, Use, and Disclose Personal Information (Purpose of Collection)

We collect, hold, use, and disclose your personal information for the primary purpose of providing, maintaining, securing, and improving the PreStartGo Solution. Specific purposes include:

  • Providing Core Service Functionality: To authenticate users, identify machines, present correct pre-start checklists, verify operator competency and site induction status, enforce pre-start completion via the Interlock Device, and record operational activity.

  • Safety and Compliance: To help our customers (Account Holders, Site Managers) meet their Work Health and Safety (WHS/OHS) obligations by creating auditable records of pre-start checks, operator competency verification, and site inductions.

  • Reporting and Analytics: To provide Account Holders and authorized Users (e.g., Supervisors, Site Managers) with reports on pre-start compliance, machine usage, fault logs, operator activity, site attendance, and safety compliance metrics. Aggregated and anonymized data may be used for broader analytics and service improvement.

  • Asset Management and Maintenance: To track machine location (theft prevention), monitor utilization, manage service requests, and provide predictive servicing alerts based on usage patterns or reported faults (if relevant add-ons are active).

  • Communication: To send service-related notifications (e.g., system updates, site announcements), respond to support requests, and communicate with Account Holders regarding their subscription.

  • Service Improvement: To understand how the Service is used, diagnose technical issues, improve usability, and develop new features.

  • Security: To protect the security and integrity of the PreStartGo Solution, prevent fraud, and enforce our terms of service.

  • Legal Obligations: To comply with our legal and regulatory obligations in Australia.

6. Who We Disclose Your Personal Information To

We only disclose your personal information as reasonably necessary for the purposes outlined above, or as required or permitted by law. Disclosures may be made to:

  • Your Employer / Account Holder: Your operational data (pre-starts, machine usage, faults reported, location data if enabled, site check-ins, competency status) is accessible to authorized users within your employer's Account (e.g., Supervisors, Administrators).

  • Site Managers / Principal Contractors: If you are working on a site managed using the PreStartGo Construction or Site Safety Add-ons, your site induction status, site check-in/out times, and potentially pre-start compliance associated with that site may be visible to authorized users managing that site.

  • Third-Party Service Providers: We engage third-party providers to perform functions on our behalf, such as cloud hosting (e.g., AWS, Google Cloud, Microsoft Azure), data storage, analytics, customer support platforms, and communication services. These providers are contractually bound to protect your information and only use it for the services they provide to us.

  • Professional Advisors: Our lawyers, accountants, and auditors, where necessary for obtaining advice or meeting our legal obligations.

  • Regulatory Bodies: Law enforcement agencies, government bodies, or courts where required or authorized by Australian law.

  • In Case of Business Transfer: If PreStartGo (Aust) Pty Ltd is involved in a merger, acquisition, or asset sale, your information may be transferred as part of that transaction, subject to confidentiality agreements.

7. Disclosure of Personal Information Outside Australia

Some of our third-party service providers (e.g., cloud hosting providers) may store or process data in servers located outside Australia. We take reasonable steps to ensure that any overseas recipient of your personal information handles it in accordance with the APPs, often through contractual clauses requiring compliance with Australian privacy standards or by ensuring they operate in a jurisdiction with comparable privacy protections. By using the Service, you consent to your information being transferred and processed overseas in accordance with this Statement.

8. Data Security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, unauthorized access, modification, or disclosure. These steps include:

  • Using secure servers and cloud infrastructure.

  • Implementing access controls and authentication measures.

  • Using encryption for data transmission (e.g., SSL/TLS) and potentially for data at rest where appropriate.

  • Implementing technical security measures like firewalls and intrusion detection systems.

  • Regularly reviewing and updating our security practices.

  • Ensuring staff are trained on privacy and data security obligations.

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

9. Data Retention

We retain your personal information only for as long as is reasonably necessary for the purposes for which it was collected, to provide the Service, to fulfill our contractual obligations to Account Holders, or as required by applicable Australian laws (e.g., record-keeping requirements for WHS/OHS). When personal information is no longer needed, we will take reasonable steps to securely destroy or de-identify it.

10. Accessing and Correcting Your Personal Information

You have the right to request access to the personal information we hold about you and to request its correction if you believe it is inaccurate, out-of-date, incomplete, irrelevant, or misleading.

  • Correction: You may be able to update some information (like your password) directly via the App or web portal. For other corrections (e.g., name, contact details, competency records), you may need to contact your employer (the Account Holder) or contact us directly.

  • Access: To request access, please contact us using the details below. We will respond within a reasonable timeframe. We may need to verify your identity before granting access. In some circumstances permitted by the Privacy Act, we may deny access (e.g., if it would unreasonably impact the privacy of others). If we deny access, we will provide you with reasons.

11. Anonymity and Pseudonymity

Where lawful and practicable, individuals have the option of not identifying themselves or using a pseudonym. However, due to the nature of the PreStartGo Solution (which relies on verifying user identity, competency, and linking activity to specific individuals and machines for safety and compliance purposes), it is generally not practicable to use the Service anonymously or pseudonymously.

12. Making a Privacy Complaint

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact our Privacy Officer using the details below. Please provide details of the incident so we can investigate. We will treat your complaint confidentially, investigate it thoroughly, and aim to resolve it within a reasonable timeframe.

If you are not satisfied with our response, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC):

We may update this Privacy Statement from time to time to reflect changes in our practices, technology, or legal requirements. The updated version will be indicated by the "Effective Date" at the top. We encourage you to review this Statement periodically. We may notify you of significant changes via the App, email, or our website. Your continued use of the Service after any changes constitutes your acceptance of the revised Privacy Statement.
